Hi there. I currently have sole custody of my 8 yr old son. I am awaiting another custody trial this Dec. and a criminal trial (aggravated assault, endangering the welfare of a child and several other things) this Jan. with my son's biological father.
My son's father has visitation at the court nursery which he hasn't attended since August. My son's paternal grandparents have no visitation rights. They have made no attempt to come to my house and visit him during this whole ordeal (since last May). Also, I was advised by the ADA handling our case not to allow any visits between my son and his paternal grandparents until the criminal case is over.
This past Saturday my son was visiting over my mother's house while I was home recovering from oral surgery. My son heard the doorbell ring and went to open the door thinking it was me coming to pick him up (yes, he was instructed NEVER to open the door for ANYONE even me, I don't know what he was thinking). It was his paternal grandmother at the door saying she was here for a visit. He ran to go tell my mother, and called me right away. I immediately went to go pick him up, and called the police. She made several verbal threats saying that she will go to his school and take him from there since I won't allow her to take him out (she wanted to take him to see their family - she LIVES with his father). She has threatened in the past that she would take my son and run away with him to either Canada or her home country, Afghanistan. She made several other threats and made several comments about our upcoming criminal case, and how my son was lying about the abuse... etc (I was just waiting for the cops and did not want to physically remove her from the house). She also shows up to all of our hearings and try's to physically remove my son from me.
By the time the police came she had left, they told me to go get a PFA. I would love to get a PFA, but I'm completely broke from all of the legal fees I have been paying for my custody lawyer. There's no way I could afford to pay another couple hundred dollars for a lawyer at the PFA hearing, AND I have the upcoming Dec. custody trial.
I have no problem with her visiting MY home (where my son lives), anytime she wants (with notification - not just showing up and barging in), AFTER the criminal case.
I already have a stay away order from the criminal case against his father, is it possible to get one against her too from my ADA?
Is there any possible way to get a PFA without having a lawyer? I tried calling around EVERYWHERE for legal aid, but everyone is already booked.
Please help. What can I do that wont cost me a fortune?? I've already contacted his school and notified them to call 911 if she tries to pick him up.
