Getting my son back from DCFS

12 years ago i ended up in prison as well so did my ex-husband for a crime that he finally admitted to doing. he is doing life on 15 for the death of my son. i got 30 years but was released early after doing nine for being there at the time although i try to obtain help the best way i could considering he was always home and never worked. he was also very abusive to me. to the point i have been out for 2years i have held two jobs and i also went to college in realestate. july 1st of last year i got remarried to a wonderful man. we are in illinois. We bought a home of our own and have 2 vehicles and he has been on the same job for 29 years. i just recently on feb.7th had a beautiful baby boy. a step cousin that don't know me at all wanted to be spiteful to me and my mom called dcfs and told them i was in prison mind you this all was 12 years ago. dcfs came to the hospital and took our baby away saying i was high risk. they are not trying to give him back but are steadily just trying to find away to take him away from me permently and my husband has never been in trouble. since i have been out i have not been in trouble and for the first time in life i was happy. can they legally take him away from me? they aren't even looking to the fact my ex admitted to doing it.i myself was also a victem. what can i do. they just cut my visits with him to one day a month and my husband gets to see him twice a week and we have to visit him seperatley. i need advice. i love my son and i want him home.

And your attorney is doing what? I mean, I presume that the day after they took the child, you retained an attorney, right?

i did retain an attorney afterwards. he is supposed to be putting in a motion to have my son come home with someone that comes in or is with me at all times when my husband works atleast for the time being. i know that one state law here in illinois says that when the call is made and due to the fact i was in prison they had a right to come straight to the hospital. but what i don't understand is this is so long ago they send people to prison for rehabilitation and when they get rehabilitated and have bettered themselves they don't care it is like they don't have no faith in thier system. also the time i did was not in the state of illinois but, in florida. but i don't see how they can legally keep my son from me permently i have done nothing but bettered myself and they are not looking at that. i did my time. they are repunishing me again. judge did not say i could not have a life or a child after prison i have no stipulations. can they legally keep him from me permently? thank you. and thank you so much for responding to me. it means alot i just want to get him back all i do is cry he is so precious and i love him so much. everybody deserves a second chance.
