I own my house. I have a roommate with no contract. Do I have to give a 30 day notice to him? If I do would I have to have him sign it for proof? If they don't leave what would be my options?

HE most likely has an oral lease. And you best read your state laws as to evictions and follow them to a T ...

UNless you can jawbone a cash for keys surrender .

He is your tenant. You will have to follow the OK landlord tenant statute regarding termination and the notice requirement.

Then, if he doesn't leave, you'll have to file for eviction through the court.

Or, as HRZ notes, pay him to leave.

Now you know why it's such a bad idea to have roommates in your house.

If you do not have a post office box , this is the time to go get one or a NON USPS box with say a shipping firm that operates in a mall. Reason being is that you want to have your mail separated from room mate so when you do issue proper notice or if you must use the courts in the end , then roommate cannot just destroy your mail, steal it or take your copies of things you would need for court . SO you have established a month to month tenancy with this person, issue to this person a simple proper notice that meets your states laws for a month to month tenant to move out, such as EG date tenant name & mailing address , this is your notice to vacate (address) by ( date that meets your states statutes signed ( your name and new PO box address) and any other information your state requires . Make say 4 copies , keep two for your records (one stored off site ) and mail the other two say via certificate of mailing and second one confirmed mail delivery, WHY (unless your state requires certified mail ) you will have sent it two ways , neither would have to be signed for but each would give to you a method of mailing that the courts would likely not reject since even if tenant tried lying & claiming they did not get notice (staggering the notices say by 2 days apart would let a Judge decide easily that you did indeed send notice and dismiss any claim by tenant they didn't get notice and proceed to evict tenant (and if the judge is annoyed enough the judge might surprise the tenant with as little as 24 hours to get out )

House Roommates

I think your right about having a roommate in my house. However so far everything is OK. I'm just trying to plan in case things become not OK. In OKC there is no lawyer referrals which means if I want to see a lawyer it's $100. I'm 70 years old and just don't know much about this. So to get the information about my situation should I spend $100 to see a lawyer or go to the court and find out and if I go to the court, what department? I'm a computer geek but really dumb in business. Any advice would be great and thank all of you for your input.

If you want to get a feel for what goes on in court when a tenant is going to be evicted you may well want to sit in on some court sessions . unlawful detainer is what its called up here and anyway eviction hearings are public , if your in a larger city the court may have set up a housing court to address housing issues only , If your in a smaller or more rural county perhaps the clerk of the court would be able to tell you of upcoming eviction hearings .
