This may sound like a strange question, is there such thing as Gravestone Discrimination?
I have a dear friend who just lost her husband last July, she has been in one legal struggle after another over the past nine months. She had purchased a Plot and gravestone for her and husband at a privately own historical cemetery. She has been receiving the run around from the proprietor for 3 weeks now and still unable to place the gravestone on her husband final resting place. The cemetery proprietor has been giving her one excuse after another. We seem to think she dislikes the gravestone and DOES NOT wish to have this gravestone placed in here cemetery. Is there anything she can do to expedite this matter? Is this Discrimination or a Civil Right matter?
I appreciate any help on this matter.

Since there appears to have been no reason given for the delay, you do not yet know if there is any potentially unlawful conduct. It could be that the style of headstone is outside the parameters of the "historical cemetery" and that might be well justified. if the cemetery prefers to maintain a certain decorum and the headstone is, say, gaudy, then they might have a valid excuse.

What does your contract with the cemetery say about headstones?

Why does the proprietor say things have taken so long?

She was NEVER giving any contract regarding headstone nor was there any conversation on Rules and Regulations of headstone. The only thing she has is the purchased price of Plot (which she signed) and in fine writing on the bottom half of paper there was wording of regulations. The proprietor of the cemetery is avoiding most phone calls place to her, from the Gravestone Granite company as well as my dear friend. The proprietor of the cemetery did say to the Gravestone Granite company she was writing a letter from the Board Members of the Cemetery. No one has received any such letter!

There is Nothing different other than the Etching on front of Gravestone. Which the etching is a scene of a moose, trees, mountains, blended in the granite nicely with NO bright colors. This gravestone depicts the story of this man life.

Yes! The size and shape is consistant with the other monuments, actually there are much bigger one's located in this cemetery.

So you feel then the discrimination is against "woodsmen?" Civil rights to put whatever you want on your gravestone?



are you aware private institutions can basically discriminate against whatever they want. Think, Jewish cemetery's, Catholic cemetarys...


Your friend has to wait. maybe she can commemorate him smaller for now.

Perhaps your friend should communicate directly to the Board of the cemetery, since there appears to be a board.

And, perhaps, a couple hopurs of time from a local attorney who can craft a letter to the cemetery that essentially says that the headstone will be placed pursuant to the purchase agreement and will be accomplished by such and such a date unless they have heard from the cemetery with a valid reason not to place the headstone.

This does not appear to be a civil rights issue in any way. It would appear to be entirely a civil issue, but not one with civil rights. That is to say, it deals with contracts, not some form of discriminatory conduct

It appears that there can be some really strange regulations on cemeteries, headstones. And from what I've seen in the last few years, there maybe should be. Actually awful (in my opinion) gaudy pictures of jumping fish, forests in bright colors, eyes of religious figures that light up...eewww! But as to whether the board of directors of the cemetery can actually regulate the type of stone, that'd be small claims court, it sounds to me like.
