What is the name of your state (only U.S. law)? Alabama


My husband has his Green Card. We were wondering if he could adopt my daughter now, or do we have to wait until he gets his U.S. Citizenship? Thank you for your help.

You need to be more concerned about kiddo's Dad than your husband's status at this point.

Is he willing to consent?

Interesting - the OP's OTHER question relates to the "birth mother" obtaining a birth certificate...

I wondered about that...maybe she was asking if she could get one free copy rather than having to pay for one?

I AM a birthmother. I gave birth to that little girl. I still love her. Am I her mother? No, I do not claim to be. I'm not wanting a FREE copy. I wanted to know the LEGAL status if i could APPLY for one.

The rights to my oldest child's father were terminated. That is not a concern.

Were his custodial rights terminated, or were his actual parental rights terminated by the courts?

There is a difference, and it's an important difference.

Parental and custodial were terminated. All this was done well before my marriage.



That's highly unusual without a stepparent adoption or the State terminating parental rights because of abuse, neglect etc.

But ok. If you say it's so - then it's so.


Bottom line? Speak with an attorney, locally. Though your ex's rights may have been terminated this still isn't a DIY project.

They were terminated due to abandonment. the last child support hearing he got verbally abusive to the judge and had to be cuffed and hauled out of court. We are going to set up something with a local after summer vacation. I just wanted to get a feel for things. Thanks for you input!
