What is the name of your state? NJ I am petitioning for my spouse who is on b2 status. we got married in 05. his b2 status expired in 04 but he was working since then without ins authorization. now that i am married to him, i will petition for him. because he has been working without ins authorization, will that affect the approval process? or it does not matter. or should I tell them that he is not working? Please advise.

You should disclose all the relevant facts truthfully but the fact that he was working without valid employment authorization will not affect his ability to obtain permanent residence if he would be filing on the basis of a valid marriage to a US citizen.
