Hello,

I sponsored my wife's parents for the green card a couple of years ago. In the process i submitted an affidavit of support. I was under the assumption that this held me liable if they went on welfare, government assistance etc. I recently found out that my in laws plan to have a major medical procedure done in the US without aqueduct insurance coverage. I called the USCIS and asked if I was liable if they could not cover the costs and the agent said I was. Can anyone confirm this? i thought that any liability to a third party (non government), i was not responsible for unless i guarantee that payment in writing. thanks in advance.

There are two entities that can take you to court over the support. The more onerous one is the government, which will do so if your sponsored person ends up on some government subsidy.

On the other hand, she can sue you for the lack of support as well.

You are right that third parties can't come after you, but it is possible that she might incur some medicaid or other federal benefit that comes back to you.

thanks for the reply. the support is not the issue. I am supporting both in laws (housing, food, etc). The issue is their medical costs and their credit card costs as a result of paying for the medical procedures. they have basic heath insurance now but will have employer provided insurance yearly next year but their out of pocket is more than they make through employment.

separate question, my father in law got a government tax credit for health insurance this year, is this considered a government subsidy?
