I was in a car accident on July 28. I was coming around a blind corner going under the speed limit when I saw a lady infront of me stopped. I immediately applied my brakes and tried to avoid her. I had approxiamtely 8 -10 feet from her when I applied my brakes. They locked. I turned my wheel to avoid her and hit her right rear end with my left front bumper area. The speed limit there is 35 mph. I was going 25. She heard me screeching as I came towards her. I tried to stop. I have been driving 14 years without any tickets or accidents. I was written a ticket for failure to reduce speed to avoid an accident. My question is....Should I plead not guilty to the ticket? I feel the ticket does not fit the incident. Can you give me any input?

Thank you.

Were there any other signs posted and was the corner a legal blind corner? If truly a blind corner there should have been a sign posted to warn drivers. Was the lady in front of you really stopped? If so, what for?

In ILL...

IT has not been declared a legally blind curve I do not think. Although someone lost their life there and there have been numerous accidents there on the turn.
The lady was turning into a convienience mart right there just straightening up from the curve. As I come around I saw her, applied my brakes and tried to avoid her. She had on her turn signal and her lights worked showing her foot on the brake. There were cars coming from the opposite direction which made her turning to the mart impossible from that entrance at the moment.

Just curious though....

My sister had the same kind of accident in the same county. She in no form tried to avoid the other car and hit them. She had the same problem I did ...brake lock up. She was issued a ticket for faulty equipment. I feel that is the same thing I deserved.
Any reply?

What was the exact wording on your ticket?

The direct wording on the ticket is as follows:

failure to reduce speed accident

It states no court appearance neccessary.

I am sorry if I sound like a whiner about this. I just find the ticket not to fit the incident. I admit I hit her but I tried very hard to avoid the accident. I have always obeyed the law and I just think the ticket does not fit the accident. Especially since I was under the speed limit to begin with. But I also understand I am responsible for my vehicle at all times.

Thank you again.
