H1B Am i being fooled ?

Hi ,

i'm on a student visa and a company in NY has applied for my H1B visa. They say that INS audit is going on and hence the processing is delayed . Is it true .

There has been an audit going on that delayed many application... what I do not understand is how you can switch from a student visa to a H1B. Have you finished your studies and got a full degree ? In what area ?

Thank you very much . yup i just completed my masters in comp sc..
I also have another question, now i'm told DOL's fax back system is down . What is that ? Is LCA needed in every case ( H1B)? Or it is needed as i'm getting a transfer from student to work visa ?
