Scottsdale, AZ.

Hi, okay so a couple of questions. I live in an apartment complex (i've only
lived here for less than a week) The parking here is very scarce, and if you
get in on the weekends after 8 PM, there are just no parking spaces available.
Its a gated community so that makes it even more difficult. my roommate said
that in the past he has parked in the handicap parking spot just because there
is nowhere else to park, you can't park on the side of the roads because its all
firetruck lanes or garages (plus the road is so narrow a car would probaly hit
you) i honestly drove around for half an hour looking for a non-handicap spot,
and so finally i parked there. i got up this morning at 7 AM to move the car,
and noticed i had been cited at 6:30 AM.

so my questions- is there any chance to take this to court and win?
2- will my car insurance go up because of this?
I'm 21 years of age and a male.

Thank You,
Ben

Standard answer on speeding/parking/traffic violations.

There are thousands of questions similar to yours on this forum.

Thus, I have prepared a standard answer.

Standby for further help.

If you violate a speeding/parking/traffic law, then you are guilty of violating a speeding/parking/traffic law.

If you think you have mitigating circumstances, plead not guilty, have a trial and explain what your mitigating circumstances are to the judge. Or, maybe the court will allow you to plead guilty with an explanation.

Hello, I live in AZ too. As far as parking violations, don't worry about being reported to DMV and insurance b/c they won't. Parking lots are private property and the police cannot come to a private property unless there is a potential criminal law broken. Are you cited by the Scottsdale police? the complex's security?
As far as taking any civil traffic violation to court and "winning" there's probably a 1 in 100 chances of that; you have slim chances. Although, if there are more people willing to clog up the legal system by fighting, there would be less people found guilty of little things.
