What is the name of your state (only U.S. law)? MN
OK, there is a guy at work, I’ll call him Ops, who has it in his head that my office-mate, of whom he shared an office with previously, is his girlfriend. It's ridiculous, he's married yet acts like a guard dog if anyone tries to get next to her despite the fact that she has never gone out with him, does not take calls after work hours, does not return text (one every single morning no matter what) or voicemail messages.
I started in 10/07 and by 5/08 was implementing a new project that required her & I work closely from that point until present. At that point, he had no choice but to allow me to use his desk and he grew quite resentful of the attention I was taking from him by her. At first, he complained like crazy but always told me that it wasn’t me personally he did not like but that I always had to be in his office. I work in an administrative position and I excel at it, t I wear several hats and they would be hard pressed to find someone else to it and he can’t for the life of him get me fired. There is a running joke about the deer stand he uses to stalk her – everyone there knows of his behavior, this borderline stalking. He’s been to her home uninvited on several occasions, scaring her by telling her what color her front door is when she did not give him her address, knocking on the door for 15 minutes knowing she’s in bed as she had treatment. She told me these and more and as we got closer, he started to resent me more & more. By now we share an office & he is in his own but everyday the hostility is getting more palpable. Everyday he tells her of another plan to get me out & him back in. Last week he had an issue with me, unrelated to any of this, and gave me a threat – through her of course. He will pace outside our office just waiting for me to leave so he can run in there to tell her he is so sick of her & I going to lunch, riding in together, running errands. If it was anyone but me, he says. Anyone at all but he can’t take anymore of this me & her together. I mentioned he is married, her & I are both female. I also mentioned that all are well aware of his actions, including my boss, the CFO, who has said to me that he sees his hostility towards me and recognizes his games he plays but I don’t know that he would say as much under oath. Another longtime co-worker & friend is well aware of the entire situation as she had sought counsel from him in regards to this.
I don’t know what to do. The new owner is a HR nightmare, he plays favorites (sales) & leads the “boys club” there. As a matter of fact, Ops is given “loans” that he forgives (to the tune of $5000), added 3 weeks of vacation on top of more than 2 weeks owed being forgiven, plus an increase - all since the beginning of the year. Talking to him has proven to be useless in the past. He also came to Minnesota when he lost his corporate position due to a sex harassment investigation.
According to the EEOC she is unprotected, and they know that, but I am not and could file a complaint on witnessing it and their lack of action to stop it, no? not to mention my own problems? Do I have anything?
