What is the name of your state? OR
I have a restraining order on my ex for abuse, documented by my daughters DR. CSD cse that was undecided, counselor records that they are fraid of their father and my daughter is depressed and has anxiety attacks when she speaks to her father. The girls are 8 and 10. He has verbally abused them to the point that they hate him. He has physically abused them to the point that they sleep with me and wet the bed on occation. My oldest said that she would rather die than see him again and that if he ever touches her again she will kill him. I also file for a modification for visitation I want surpervised. He has accused me of arson. And last week he was in my backyard with a shovel, the police came over with canine but the man jumped the fence, they did not question him. Now he has filed for sole sustody of my girls claiming alot of lies about me. Because my children refuse to talk to him and they refuse to get into my car so that I can drop them off at his house. I was told not to physically put them in my car, they scream and yell at me when I have tried. He claims that he has seen me around town without the children, thats a lie. He claims that I am brainwashing them, I dont have too he does this all on his own with his abuse. No I do not have a attorney I can't come up with the retainer and beleive me I have tried. I am so sick of this man causing trouble with the girls and I. He also states that he wants me to have very limited visitations with girls nd want me to pay support and wants his rears that he woes dropped. This case is going to court July 26th along with the restraining order and the modification that I filed. So what do I do besides keep my children safe and keep taking them to counseling?

The only way to resolve it is to get all your info in front of a judge. If he files for full custody, you file a response asking for full custody.

If you are being truthful and you have documentation you should file first.
