What is the name of your state? CO
Currently I am paying for the health insurance premium for my daughter. She is 17 and will be 18 this coming Oct. My daughter resides with me but has told me upon her 18th birthday she is going to move back to her mothers residence. She will still have 2 more years of school to complete. Since she is reaching age of majority am I legally obligated to continue paying premiums? I talk with the insurance company and they said I would no longer be able to communicate with them due to the fact she will be 18.

is there a reason why you would be against ensuring your daughter has proper health insurance coverage and by extension proper medical care if needed?

Well she will be out of state and I can't carry insurance while she's not living with me and in another state. She is declaring her independence with a little help from the ex-wife. The court order says she is to remain her with me until she graduates from school.....But unfortunatley the age of majority took that away. I feel shes much better off living with me but thats a decision she is making now. So let her mother take care of the health insurance since she quite obviously forgot why she sent her to live with me to begin with. Her mother doesn't care much for her when she has seizures while visiting her and she doesn't take her to a doctor nor hospital. This is the type of person she is. I say let them lie in the bed they are making for themselves. Bitter? nah....just tired of all the games they are playing.

regardless of the mistakes this girl is making- and at 18 people make a lot of poor choices- she has a medical condition where she has seizures.....is mom going to provide insurance? or is there a way you can help mom provide insurance?

I somewhat recall your situation. She was with Mom, Mom couldn't handle it, she came to live with you - there has been improvement but she wants to move back with mom...It was determined that your daughter had the "right" to overrule the court order due to her age? I had thought that perhaps you could argue that as a result of the delayed development? Could a doctor's opinion (expert witness) support your own thought that your daughter is not really qualified to make this decision?

I'm sorry if I'm remembering the wrong case...too lazy to search it out

Well knowing mom she probably assumes it will just continue on my part.....but she needs to realize that I can't carry her when she leaves CO. Unfortunatly she does not talk with me anymore and whenever I try to talk about our daughters issues she turns it around and says all I do is bitch about her and doesn't want to deal with it. SO.....answer to your question is NO.....I will not help her when shes in arrears of thousands of dollars to me because our daughter has alot of medical and mental issues but fail to acknowlege it with me.

Before anyone gets all Eighteen-ish about this issue, do remember: Colorado is one of those weird states that requires CS till age NINETEEN, and court orders for CS -- and health insurance -- go through age NINETEEN.

Of course, the legal age of adulthood is EIGHTEEN. And Daughter can move wherever she wishes...but DAD and MOM are still bound by court order to treat her like a bebbie till age 19.

Doesn't matter. The court order from the originating state rules. Unless both parents agree -- stupidly -- to rework the whole thing in the new state. Otherwise, CPs would be flooding IN and NY to get CS till age 21. That kind of forum shopping is not allowed.

Besides, the "child" is moving to NE, which has the same dumb 19 rule. ;)

Well by the way the insurance company is acting I have no legal rights to talk to them after shes 18......I am assuming I am not legally obligated. She will be moving to South Dakota.....but jurisdiction is here in CO. The divorce decree says nothing about who is liable to have coverage on her.
