What is the name of your state? Pa

My husband & I have been married for 12 years we have 2 children 7 & 8 we live in Pennsylvania. A few days ago 2 18 year old boys came to my door claiming they are my husbands twin sons. They say their mother passed away a month ago & she told them my husband was their father. My husband was with their mother. My husband was 18 & visiting his mother in Pa while on leave from the navy. At this time he lived in the state of California. A 36 year old women was staying with my husbands mother and they had relations in the 2 week visit from my husband. The 36 year old told my husband she was on the pill & using another form of birth control. The relations happened & my husband went back to the navy. Now 18 years later these boys are saying they are the result of those 2 weeks. The women put my husbands name on the birth certificate without him ever knowing anything about this until a few days ago. All this time this women still knew my husbands mother & family & could have very easily informed him of this but never told any of them that she thought these boys were his. Now after this women has passed away these twin boys are talking about filling for retroactive child support from me & my husband ? We are not even sure these boys are his - I question that if a 36 year old women would have relations with a 18 year old boy she knows for only two weeks who else did she have relations with during this time? If my husband would have been told & proven the father of these boys back then I am sure he would have taken care of them, but know it is frustrating to have these twins act as if they are getting revenge on him for something he had no idea of. They said they will get retroactive child support for both of them & bankrupt our "nice " family. How can we even find out if they are my husbands twins & if they are will they be able to get retroactive child support with interest after all this time in a lump sum? If their mother had wanted this way hadn't she done it when they were alive she knew where we lived. How will they take into account what the mother made since she has now passed. How will we know if the mother was living with someone who provided for these boys? Please help it is tearing our family apart.

It's a little too late for them to come looking for child support. They're 18 and legal adults. The only person who could have sought child support was their mother. Just hope and pray she was never on any kind of government assistance.

But if your husband is wanting to know if these children are his or not, he should ask the boys to agree to a DNA test.

You don't mention which state they would have been residents of, but the majority of states do not allow retroactive support to date of birth for a person who is already adult age. And most won't allow filing CS AFTER a child is 18. And paternity would need to be established if there was a filing. Her putting his name on the BC does NOT legally establish paternity. If there was a never a CS order, CS can't usually be ordered prior to date of filing. And the money would be owed the CP, now deceased. IF there ever is a filing, demand a paternity test and get a lawyer.

Sounds to me like they are trying to shake him down to give them a nice payoff to go away. Based on the comments that were made. Could even be a scam. DON"T pay anything unless and until there is a court order to do so.

My response:

This is almost comical! I've got this image of "Tweedle-Dumb" and "Tweedle-Dumber" standing at your door!

Obviously, these two idiot twins have never consulted with an attorney. They just think that they've found their "Pot 'O Gold" at the end of the rainbow. Well, I've got news for them - - they're at the end of something, but it ain't any rainbow!

Child support is for the custodial parent. Children do not have a "property right" to child support, and on top of that, they have no "legal standing" to sue - - only their mother had that right.

Tell 'em I said to go blow it out their respective asses. Your husband doesn't have anything to worry about.
