Help a Young Father

What is the name of your state? KY

My son's wife left him and their 2 babies last April. She made no attempt to see the kids from the first of April until the end of June. My son found out where she was staying and took them to her because they missed her so much. She kept them 1 week and brought them back to him and has made no attempt to see them since then. They have finally adjusted and don't ask about her any more (they are ages 2 & 3). He has tried to find a lawyer so he can file for divorce and custody, but they all say they don't handle contested custody cases. Even though she doesn't want the kids, she would contest just for spite. Can he petition for custody without a lawyer, and how would this be done? She has also abandoned and lost custody of 3 other children.

Yes, he can do it without an attorney, but its really not the wisest thing to do....particularly with something that is likely to be contested. There are plenty of attorneys that handle contested custody cases, but maybe not in the price bracket that he is currently looking at. You may need to help him financially.

He should log all mom's contact dates and time spent with the kids during this time. It will be helpful to his case and show mom's disinterest.

**A: there are many lawyers that handle contested custody cases. He just has to keep looking.
