I went into court a couple weeks ago for a speeding ticket that I had plead "not guilty" to and the officer did not show up. I was under the assumption that the case would be dismissed because he was not there. When I was called forward the Judge told me that we will continue on another date. When I asked him about a case dismissed because that officer was not there he told me that the officer was on vacation and that the Court had 45 day to get me to trial and it had only been 27. Correct me if I'm wrong but doesn't the officer have to show up to request a continuance? If this is true what is the law that states this? I have to go back to court today and there is still about 10 days left before I hit 45.
