Hi you all out there. Would be grateful if someone could advice on the legal issues (if any) of an USC spouse married to an alien decides to keep deceased husband name, for the sake of the children born with late husband? For petitions filed in such cases, do the spouse or petitioner use late hus. family name or her own family name on the forms? Which names constitute maiden names? Bravo and thanks in advance for your great legal minds.

You use whatever if your current legal name on all the forms. If you have changed your name on the social security card, then that is the official name you currently hold and you would simply need to document the progression of the different names through marriage, etc. Your maiden name is always the name you were born with--the name you had before any marriage.
