What is the name of your state (only U.S. law)? ny
Husband has been in U.S. Illegally for 40 years. Has worked, paid taxes, filed income taxes etc. When we first were married 40 years ago, he got his social security card and we had no idea he was not legal. We were 18 years old at the time...now we find different...any help?What is the name of your state (only U.S. law)?

No, if he entered the US unlawfully and no one had ever petitioned for him, there is no way for him to legalize his status within the US under the current immigration laws. He would have to go back to his home country to consular process but by leaving the US he would trigger an automatic 10 year bar to reentry which can only be waived by a showing of extreme hardship to a US citizen spouse, which is fairly difficult to do in most cases.
