Help! Hospital unorganized and malicious!

Hello,
Last July I was involved in an accident while at a bar. When drinking one night, I tried walking home from a Local Bar in Greeley CO. I got out the door, down the road, and there I fell and passed out. Later that night the Ambulance picked me up and took me to the ER. The next morning I woke up and the Doctor told me a little of what was going on, then he told me I was going to detox. I spent the next 8 hours in detox till I was able to blow 0's and go home. I feel I was held prisoner in Detox because I kept asking to leave. The representatives in Detox would not allow me to leave, even though I was not brought in by any law enforcement officers or in fraction of any laws.
I felt violated of my freedom, and not till recently when I started taking Legal Enviornment of Business did I think of unlawful behaviour.
Do I have a case against Banner health?
To top it off, They sent me into collections after offering me financial aid. They had me sign a bunch of paperwork and stopped sending me monthly bills, then all the sudden I get a letter from collections!
ITS RUINING MY LIFE! :(

Nursing homes, psychiatric facilities, and other medical facilities

Contrary to popular belief, a nursing home, psychiatric hospital, or medical facility cannot restrain, medicate or hold you without your consent or a court order. This includes physical restraints, threats, coercion, and chemical restraints (medications).

If you sign a voluntary consent form then you are not being held against your will, unless you sign the form because you are already being restrained or due to threats or coercion.


Found this while researching, Anyone have any other advice or any other help?

My mental stability is quite fine, I'm just questioning the legality from one bad night!

I'm sure you've never been in a situation where you have been taken advantage of?
No need to justify, I'm simply stating facts of the law and the situation that happend to me. You need to go watch "Days of our lives" or some spanish soap opera, clearly you do not have enough drama in your life.

Anyone reading this - at any time of day - will disagree with you. Nothing in your post indicates you were taken advantage of, and even if you were, that is not grounds for monetary damages. You have no case.

Just saying brother, You're quick to judge.

People come to these forums for advice on a legal system that is constantly changing. Situations always have a longer story than the paragraphs we give them. You are not on any grounds to attack anyone on these forums personally or judge.

Might want to take that into account in your near future.

Yeah, read a little further. What you posted as fact is not fact; it is a load of crap.

Yet you still had enough time to get drunk enough to pass out in the street and need detox. Imagine.

You were kept there because you were a danger to yourself and/or others. If they released you knowing that, they (the Docs & facility) could have been held responsible if you were injured, or worse.

Now get the violin and cue: "Nobody knows the trouble I've seen......":rolleyes:
