Hello to you all. I have a situation I am hoping someone can advise me on.

I am LPR since 1 year. I got PR through my Dad, who is now a USC. I am married, but could not add my wife to my adjustment, because I got my PR through my Dad. My Dad and I are orginally from Jamaica.

So if I gave up my Green Card and have my Dad file all over again for me, what category would I then be in ? Could I then add my wife to the new petition ? If so, how approx. how long would the process take ? Would I have to leave the US during the process ? My wife overstayed on her student visa, less than 180 days, so would that be a problem for her to be added to the filing process? She is still in the US.

I do hope I can get some good answers.

File the I-130 on behalf of your wife. It will be about the same time if you were to give up your PR status (which would be just downright stupid at this point) and have your father file for you as a married son as it would for you to file on your wife's behalf while you are a PR
