What is the name of your state? What is the name of your state? New Mexico

My teenage son went to work and received a letter stating that he was suspended (with pay) while an investigation is conducted. They would not tell him what the investigation was about, only that he should return to work on a certain day and time.

He has admitted to me that he did steal from the company. He used a gas credit card for personal use, and there could be other items of which he stole from the store.

I am afraid that he will go there Monday morning, only to be arrested. My question is....How likely is he to do jail time? and is what is the dollar amount between a misdemeanor and a felony charge (should the company decide to pursue)?

When you say he used a gas card, do you mean that he used someone else's credit card? If so, that's Identity Theft and it's a felony.

yes, the card was given to him for company use and he used it for his private vehicle.

No one but your son's employer can say for certain what is going to happen. Anything we say is only going to be a guess.

That being said, my guess is that it is unlikely that he will be arrested or charged with the theft. It is quite likely that he will be fired and that unemployment will be contested. It is also possible, but not certain, that any references that this employer provides in the future will reflect at the very least that he was fired for misconduct.

I appreciate all the responses. I'm at my wit's end with this child and wonder if a night or two in jail wouldn't be the best thing for him.

Of course, no mother wants that for her child...but lesson must be learned from this.....Stealing is against the law. Period.

If he's arrested, tried and convicted for this, his jail time will be more than "a night or two." If he's an adult, the record he'll acquire will dog him for the rest of his life (his job and career options will be seriously restricted, to put it mildly), no matter how well-behaved and law-abiding he is from now on. Try to make him understand this.
