fiance divorced in Fla 3 yrs ago, now lives in Ga pays the house payment for the house they had together, can he take her back to court to get that reversed? He signed in the divorce to pay for 5 yrs, didn't consult a lawyer, just signed. He has no children with her, though she has 3 children from previous men. Ages 21, 15, 13.
Please resond if you know of anything we can do.

NY: The important questions that have not been answered about the commitment to make house payments for 5 years are these: Was this house deeded in both names during the marriage? If it was the separate property of the ex, did it appreciate in value since the marriage and up to the time of the divorce? Does your fiance stand to share in any part of the net proceeds upon the sale of the house? Finally, was this commitment to make payments on the house for 5 years in lieu of alimony to the ex?

As far as "reversing" the divorce provision regarding these payments, just because one party chooses not to have independent legal representation does not mean that the terms of the divorce agreement can easily be overturned, especially if the provisions were not unconscionable (exceedingly unfair) and there was no provable overreaching or coercion involved when entered.
