In April of 1999 I was going to marry my best friend. I got pregnant and after a while my best friend and I parted ways and I went back to my exboyfriend. My best friend told me to have an abortion because he didnt want to have a child any longer. I wanted my baby ,so I told him I would do it in my own if I had to. My boyfriend and I got married when I was 6 weeks pregnant. When the baby was born my husband signed the birth certificate even though he was not the bio. dad. He has supported him the whole time.We have never been to court.We live in the state of Ohio.
The bio dad lives in Nevada. I do not want any support from the bio dad. He now says he wont sign papers relinquishing rights because he doesnt want Dylan to think he was not wanted by him. He says to leave things as they are. I want some protection in case he changes his mind. What are my rights, and is there a time period in which he looses rights? Can he asks to have rights to my baby even if he didn't want him? DYLAN IS 3 MONTHS OLD.

It is not as clear cut as you say. Courts favor natural parents keeping their parental rights over arguments between the parents. Sooooo....to answer your question, there may be a possible abandonment issue. I don't agree with you -- he SHOULD keep his rights since that child is entitled to be legally tied to his natural father.

You don't agree that a child should be in a loving and stable home, whether it is with the biological or not?
What about what's in the best interest of the child. I think broken homes destroy children sometimes, and I dont want to take that chance with my son.

The biological never signed the birth Certifacte and is not listed as the father then he has no legal right to the child. I am in the same situation my son's father has never been around therefore his name is not listed on his birth records, and when I spoke to a lawyer to have my son adopted he told me the biological father has no right.
