I got divorced in las vegas now my ex wife wants to fight for custody lives in California what state does she need to file in CA or Las Vegas?

Did your divorce address custody of the children at all? How long has she been in California. Are the children with her? Where do you live and how long have you lived there?

Latest custody papers I have primary custody.

She been in CA for 2 months.

She has the child now

I have lived in Las Vegas 20 years

She can't change the order to CA unless you agree. Don't agree.


When is she supposed to return the child? This is just her summer parenting time, correct??

No her mom send her a bus ticket with my knowledge and she ran off to CA and is noting coming back

How old is your daughter?

Mom can't change the custody situation just by sending a bus ticket to the child. You can go get the child: bring a copy of your custody order and ask the local police to help you.

Or file for Mom to be held in contempt.

Or both.

(Or you could call Mom and tell her she has 2 days to get the child back to you or she'll be facing contempt charges - and see if she cooperates).

I've got a bit of a different point of view here.

Your daughter is 16. She apparently wants to live with Mom. Now, it's of course true that we cannot let our kids rule the roost or make such decisions themselves.

BUT.

At 16? You may need to consider what a protracted fight will do to your relationship in the long term.

That's a good point. It's impossible to give advice on a non-legal question like that. Only OP knows whether it's worth the battle.

Legally, OP is likely to win. You are absolutely right to suggest that winning the battle might mean losing the war.
