Help with Georgia case

What is the name of your state? California
I and the child involved live in California, my case is in Cobb County but we have to file in Cherokee County that is were my ex lives. I'm trying to fix a court order from our divorce that just doesn't work any more because I moved home to CA and he just does what he wants. My lawyer is telling me I have to appear in court in person unless I get the courts permission. I'm wondering if anyone knows how to get the courts permission or some way or law that says I can appear in court over the Phone.

What exactly is he doing that he wants to do?

What court order are you trying to get "fixed"?

Instead of paying the court order amount he pays as he feels. Deducts for plane tickets and say that if I want to argue about it I can send son every other week like order says.

My original divorce, child support, visitation order.

most CA courts will let you apear by phone if it is set up ahead of time i suggest calling the court and asking what their rules are

He shouldn't be deducting from the support, so he is wrong for that however, is there anything in the order that says that he is to pay for the travel? If not, I can understand his anger as you are the one that moved.

Ok but this case is being heard in Georgia not in California.

And you are obligated to send the child EOW until you have the orders changed and dad can file contempt charges against you for not sending the child EOW.

So again I ask did you get permission from the courts in writing that you could move across country.

still don't most courts let you do that :confused:

I moved in 1999. I did not have anything in the order to stop the move and he did not contest it. I'm not pissed at him, I am trying to fix the order and paying a lot of money to do it, to keep the peace and fare support amount. He did see his kid but he waits until the last minute to make the arrangements and I’m not pay for that kind of ticket. He can pick up a phone. I just want an order that will work which I'm working on. Just trying to find out about the appearing by phone.

i would still suggest calling the court where the matter will be heard and ask them about their policies regarding appearing by phone:)

Have your lawyer request that you be able to appear via Phone. as someone said most of the courts will allow it.

I still think that you are going to be required to pay all the travel expenses though since you created the distance.

The order may be changed from him not getting every other weekend but I would expect he will probably get al of Summer vacations and alternating holidays.

Yes I agree with you, but he will have to pay me the full amount and make arrangements in advance. I want my son to see his Father. I just want something fare to work with. I will try to find the number for the courts and I have asked my Lawyer to look into it. Just helping him out. Chances are you will be paying the full amount as you were the one to create the distance....

Agreed he will have to pay you the full amount of child support but you will probably be required to pay full amount of travel expenses.
