I hired an attorney to modify visitation of my 5yr old son. I am cp. This was two months ago. My attorney stated that since both my ex and I live in a different county then original order was filed that my best bet would be to have her file a motion to transfer to a different county then she would file an osc. It has been two months and she still has not filed the motion to transfer. I keep getting the run around when I call the office. I have left several messages for my attorney to call back but as of yet she has not called back. I don't really know where to go from here. I have already paid her $4000 to do this and I don't have the money to just go to a different attorney. Any suggestions on what I can do?

On Monday morning tell (or leave a message) for your attorney stating you want her to immediately file for a transfer of venue, and if she does not file by the end of the week (or contact you as to why she can’t) you will have to seek legal counsel elsewhere and will expect full reimbursement of the unused portion of your credit.

Read the retainer agreement that you signed first, tho, to see if the retainer is reimburseable or not.
