OK the last several weeks dogs of a neighbor who have moved into her mother's garage have been in my barn attacking my animals. Over the past same time the women's dog's have chased a few people 5-7, it caught me as it ran out of the woods one night at about 10:00pm and caught my hand as I had my hand hanging out the window, broke skin and scratched the hell out of my truck as well I nearly soiled my pants. Well Monday as I cut my relatives grass I was arrested for threatning to cut her throat as well as her dogs. Said I took a knife out of my pocket, had shorts with no pockets, at least 6 witness' seen incident which took place 100 feet from her property, she came to get her dog as it was going after me. I was released on promise to appear.
On Friday I walked to relative's house who is old and check on him nearly daily in the afternoons. Well as we sat on the side of his house 200+ feet away we heard the womens husband pull in the driveway get out of the car and yell that Mother F_____ MY name just tried to blow my head off. I said to my Uncle well better go get ready for the cops. 10 minutes later I'm arrested for breaking the origional order. Friday at 3:00 a 50,000.00 bond wa set, never seen judge was done with out my presence sat in jail in lockdown until court monday in a holding cell with 15 others at 130 degrees with no cold water only hot. Told Judge this bogus, her own daughter showed up to explain to the Judge her mother hasn't taken meds and she has done this to other neighbors over the last 25 years, and has been instatutionalized 4 times in three states the last 10 years. Not till 7 pm did I find out I'm released on $2,000.00 bond.
My ? I've been hiding in my house now and must go out, I have to pass her house to get out, she will call them again and I was told that if I get arrested I will sit in jail until the court date in 8 weeks. I must pass her house at least 8 times per day with the kids school and sports. Help !!!!!!!!!!!
I go to the lawyers at 4:00 today

Yes I did origionally went to the sheriff they sent me to animal control last week, I'm still waiting for their return call.

Well, leave the gun and the knife at home for starters.
You can always contact the police to keep the peace if you have to pass this insane asylum, but they are certainly not going to come help you walk down the street eight times a day. So you can call a cab, or possibly have someone videotape you the entire time your walking to your destination so you can prove you didn't point a bazooka at her when you passed by.
But are you sure there isn't a long way around the block you can take to get to your destination without going near her or her property?

I also don't get the part about her dogs, what do all the points you posted about her dogs, or her daughters dogs (I think) chasing people and making you soil your pants have to do with anything? Did you threaten to do any harm at all to either her or her daughters dogs?
Has anyone filed a complaint against her with animal control for not keeping control over her dogs?

Also, you said that she claimed you were threatening to cut her throat and the dogs throat as well, which was the reason for your first arrest. But then you claim that it was her husband that shouted that you were going to blow someone's head off.

So if the daughter went to court to talk to the judge on your behalf, wouldn't she have to say that both her mother and father suffer from mental illness that has them filing charges against people for 25 years and wouldn't this daughter be the one who moved into the mothers garage with the dogs?

First of all it was a different daughter, she told us mom hasn't taken her meds, the Hunsband of the mother also went to a relative and said she wasn't taking meds, he is an over the road trucker and leaves for months at a time, the daughter told us he don't want to be home.
It is a women around 60 and one of her daughters doing this together.
The daughters husband was the reason for the second arrest, the cutting of the throat threat was the first. For some reason she just unhooked the dog and let it rip.

You need to find out if the dog is vaccinated and the owner can provide proof of said vaccination. The short end of the incubation period for rabies in humans is 20 days. After onset of symptoms, the disease is fatal unless you have been vaccinated.

I was recently bitten by a neighbor's dog after it jumped through a window into my house. The post exposure rabies vaccination was well over $4000. In my case, the dog was injured due to neglect and was destroyed before quarantine could be completed. A deputy was present during the incident. We all had a few choice words about the dog's owner, much as you did.

The local health department is required to investigate dog bites and report to the state. Such documentation will assist your defence, so don't sit back. Call your local health department and/or animal control.

Went to the lawyer Tuesday evening and he did say have a camera. Now have a video camera on the dash of my car when I go by the house actually before I get over the hill and a few miles past. He said the charges where a joke and will be dismissed but in this county he said the hard part is getting to court if you are in jail. :mad:
Lawyer did state that NC was one of only a handfull of states where you could have a warrent issued on a he said she said no ?'s asked. He also said since bond was revolked once already the next time I'm arrested even with witness' and video less then 50% chance of him even getting me out until the court date.
What's the deal with the phone calls you have phones available one hour per day at different times per day while in jail BUT they are a private company and to call you have to have a block removed from the number you are dialing for 25 dollars then put 25 dollars in an account for credit, BUT if you can't call a person to tell them that how are you to call them. What's the deal with law allowing you to call someone. :confused:

Went to court friday and sat most of the day, the women who pressed charges showed and sat there. When they called my name and she saw all my whitness' plus the fact I had an attorney and my video camera she got up and just left. I asked my attorney if he was going to ask for the case to be dismissed and he told me they are allowed to miss one time that now will be subpoened. The prosecutor asked the judge to reschedule for 6 weeks later and he granted. If they don't show the next time my attorney says it will be dismissed then.:)

How could people do this to someone, this has now cost witness' 9 total days work, me nearly a thousand dollars in lawyers and a bond. Will the prosecutor go after them for filing false reports if they don't show the next time. :mad:

You could have your attorney submit a motion for depositions. If complaintant refuses deposition, your attorney could then submit a motion for dismissal. Saves your witness time.

update!!!

Went to court twice now, first time the people asked for a continuance and it was granted, second time these folks witness' who where subpeoned didn't show. The Judge and prosecutor said we must attempt mediation my attorney said it wasn't necesary I was not guilty of anything. Oh well
Went to mediation and explained to the two used to be attorney's all the hours of videotape, still photos, and several witness' to all her charges, even though the mediators aren't to give advice they suggested to the plaintiff that this really should be settled with what I had. The women said OK I just want this to go away alright, signed some papers and left. I was told I must still go to court and go infront of the Judge to have this dismissed and I must pay a court fee of $65.00.
What a racket, I sit in Jail for 5 days have to pay for a bond and a attorney and now have to pay 65 dollars for doing not a thing wrong. Is there nothing the goverment won't do to make money. Go figure.

Well thats what happens when a county issues felony warrants over the phone without ever asking a question of anyone but a syco old lady who does this regularly.(Yes in three states). I could of been in enother state or country they would have never known would they. And we already looked into counter suits but she rents and owns nothing.
And yes the county does get reimbused for my jail time. An hours worth of work would have gone along way!


Your $65 doesn't cover the cost per hour of the court clerk and stenographer, let alone the cost of the judge's and prosecutor's time. Oh, yeah... there's also the cost of paying the jail staff, bailiff, etc.

Yeah.... the Government really made a bundle off you.
