What is the name of your state?Florida My grams husband passed a year ago. He left her his life insurance, and ALL net income from his accounts ( about $800.00 a month), plus for her to live in the house he purchased until she passed. The eldest daughter the trustee has not sent her a check in over 3 months. Anything she can do??

Her husbands children would like to say she is a bunch of things. I believe because she has received a fairly large life insurance policy ( that she is holding onto incase her health does fail, and she needs care) But she drives to the hair dresser,golfs every Monday, does her own banking, shopping etc.. Keeps an impeccable $400,000 home in an upscale retirement community that isnt hers, she is just allowed to live in it per the trust, until she passes.

Gram needs to make an appointment with an Elder Law attorney (one that does trusts), and drive herself there. The trust can pay for the attorney. The attorney will know what to do and can review all gram's estate documents and deal with the trustee.

Thank You for your response, you made a point to say she needs to drive herself. Depending on were the attorney is located she will possibly not want to drive say on a busy highway etc.. The very large community she lives in doesnt go over 45, and has all amenities needed, and way more for recreation and living. I was going to take time off work if she needed me to drive. Is this not advisable, and why?

You are very welcome.

Gram doing all this upon herself demonstrates her being of sound mind and not influenced by anyone. Depending on where gram lives in FL, she could even have an attorney come to her home. There's very little reason for one to drive on a busy highway in FL. One can travel all over FL without taking a major highway.
