Okay here goes...I live in California. My grandmother died last July and left me her house in Philadelphia in her Will (only beneficiary). I am also the Executrix of the Estate. I want to sell the property but have a tenant living downstairs with no lease, it was verbal. I found an attorney online, paid him $350 to evict the woman down stairs. I sent a 30 day in August 2004 asking to be out by October, nothing. Finally get a court day in February and it was continued because I had to appear. I flew to Phila, appeared in Court in April, got a judgment for possession. Fine. But she appealed! Now court is set for October. She pays nothing! And I have to pay another $3500 which I don't have. She has lived there since 2002 so she says. Now. I find out in trying to sell the house that my grandmother never kept the zoning permit up and the house is zoned as a single family and not a duplex. So can that be my ticket out of this mess? She lives in the downstairs apartment and my Grandmother lived up stairs. The main address is my grandmothers apt, #1 and I still get the water bill from the city because she is the owner. Are there any zoning codes broken here because she been living in a house without a multi resident permit or is she now considered the single family occupancy because my grandmother is deceased? Please can anyone explain how someone can just live for free and the courts give them over a year+. Is there a loophole in this zoning issue :confused:

Don't know nuttin about zoning... but a 30 day was served? Not a 60 day... after living there over a year...

Um your tenant found the loophole..
