I filed a civil lawsuit against an ex boyfriend Peter J. Thomas in July 2008 in Phoenix AZ. During the case of the action, my mental health records were subpoenaed. I later dismissed the lawsuit in March 2010. The attorney for Peter Thomas, Jake Curtis, gave copies of my Mental Health records to Peter, and Peter has disseminated my records to Glenda Down who has nothing to do with my case. She has filed numerous frivolous injunctions against me, making false claims and accusations to harass me and has appeared in Court 4 times with my medical records. Each time I have asked for a hearing and explained to the Judge that she has no legal right to possess my private/confidential medical records. The Judge instructed me to file a complaint with Cthe Civil Rights Office and to hire a lawyer. Just last week I was served another injunction in Indiana where I live. Again she has made false statements and used my medical records to obtain the order. I have copies of the videos of the Court hearings where she is clearly seen giving the Judge copies of my Medical records. I want to sue her. What do I do?

if you want to sue her, hire a lawyer and sue away. There is no HIPAA violation because she is not bound by HIPAA.

I suggest that you remove all real names from your post, unless of course you want your private/confidential mental health records to make additional appearances in court when Peter, Jake and/or Glenda decide to sue you over what you choose to post about them here.

Then do as the judge (and justalayman) advised you. Hire an attorney to review all of the facts, file a complaint if the facts can support a suit, and sue.
