HIPAA Violation?

What is the name of your state? Michigan

I have a chronic condition in my foot that requires restrictions on how long I can stand/walk. I asked my doctor to write out the restrictions for my employer. The doctor took it upon himself to call my immediate supervisor and discuss the restrictions. Together they came up with the restrictions to be put into writing. This bothers me on two levels. While my supervisor was well aware of my current problems with my foot, I am not comfortable with her speaking with my doctor about it. Second, my employer was able to have input on what my restrictions should be. It seems to me that should have been between me and my doctor.

Is discussing my restrictions with my supervisor a violation of HIPAA? I know where to file the complaint, but do not want to waste their time if it is not a violation.

You may want to move this to the employment and labor law section. When you ask for accommodations for work it is common for the physician to discuss them with the employer, you consented to this in asking your doctor to supply the letter. Depending on the size of the organization it may or not involve your supervisor. An employer is not required to grant each and every accommodation you request, so that is why they may need tospeak with your provider.

It is not a violation if you consented to your physician sharing info with your employer. It sounds like you did that when you requested a letter be written.
