Back in April I was hired as a live-in driver for at least one year by “Mark” who had his driver’s license revoked for one year, DUI. “Mark” was a company software salesman and we averaged about 350 miles a week, all over southern California. Payment was room & board, food plus $100.00 a week. After 4 months “Mark” quit his job and after paying me the $100 a week for another month, at my insistence, he quit paying that. He won’t go back to work, has a serious drinking problem and I’m buying my own food. Over something really stupid, he is now kicking me out of the apartment. I have till the end of the year. Merry Christmas . . .

I did not sign a contract, all I have are the emails we sent back in forth that got me the job. Do I have a case? If so, what can I claim? Small claims?

A claim for what? He has given you enough notice. How much are you driving him now? How much did you drive him after he quit his job? In what state is this?

I would cut your losses from this loser and run. The headache isn't worth your time and money. Serious drinking problems get worse and worse, and the vortex will suck you down with him. Get out while the getting's good. You have until the end of the year. Plenty of time to hustle on and forget that waste of humanity.

Perhaps this might pass for reasonable personal advice. However, as legal advice it is irrelevant.

OP, even with room and board, you weren't being paid much.

It is unclear what you think you're entitled to. He's not working, doesn't want your services. Why should you get to stay? You are no longer earning your keep.

Shall we assume, with the absence of a written contract, that there is also the absence of employment records for all other purposes? (IRS, unemployment, etc.)
