I was hit by a driver when she backed up into me. She gave me her insurance info. but now that I reported it to the insurance co. I was told she's not insured with them as of 2004. There is a posibility that she does have insurance with a different carrier but I am not sure. She won't return my phone calls. I do carry UM coverage but if I go through my carrier they usually verify if indeed she's uninsured, correct? I just wanted to ask you- if she is uninsured will my insurance company go automatically after herl?

Your insurance company will try and obtain her insurance information from the DMV. If she is uninsured, they'll use your uninsured motorist coverage to pay you. You can then file a case in small claims court to get your deductible and the rest of the damages back. You'll have to return the rest of the damages above your deductible to your insurance company. They should provide a lawyer to you to help recover the money since it's in their best interest.
