hit in Walmart

What is the name of your state (only U.S. law)? CO

My mother (who is 85 years old) was hit but the stack of shopping carts being driven by the motorized cart handled by the walmart employee in charge of collecting the carts and bringing them into the building.

She was standing in front of a line of carts inside the store, about to reach for one of them; when the employee rammed the stack of carts from the other end.

She was knocked over backwards and slammed her head on the floor. She was knocked out.
My father (who is 89 years old...and has suffered from a couple of minor strokes) was there. Walmart called an ambulance. She was transported to the hospital. When she woke, her clothing was soiled..and on top of everything else was totally embarassed by it. They had her strapped onto a board and kept tied down for a hours while they did MRI and Xrays. She could not change her clothing. She was not apparently suffering any damage...but had headaches for a few weeks after.

About a month later, she was contacted by someone with walmart insurance company. The man talked too fast, and not loud enough for my Mother to hear or understand him. I took the phone when she asked that I talk with him. He said he needed her signature to get the medical records concerning this. I told him to send them out.

About a month after than, he called back again....wanted to know if she was still having headaches..or seeing a doctor about it still. I asked Mom his questions, and she said that she wasn't having the headaches any more. I told him what she said.

A few weeks later, he called again. Again..talking too fast and not loud enough..I took the phone.
He offered her $2500 and she would have to pay the ambulance fee ($964.00) from that amount. I told him that I thought that was an insult given what she was put through...but..it wasn't my decision..I would tell Mom what he said. He called back a week later..I told him that Mom was willing to settle right away if she got $5,964..and she would pay the ambulance from that. He refused..got mad..said "we had an agreement!" There was no agreement I told him. Well, he said we had an "understanding"... we had no understanding. I was only the person passing on the message.
He tried to tell me that he couldn't offer more because that was the limit permitted by Medicare....huh? that sounds like crap to me. He said that it would be many many months before there could be any other settlement and maybe not even that much.

OK...I'd like to convince my Mom to go to a lawyer and sue for the largest amount of money she could ever possibly get. These people never once expressed regret for what happened to her, or acknowledged how horrible this was for her. (ever been strapped to one of those boards? is becomes quite painful very quickly, she was kept like that for hours.) If this were me, I would be seeking $2,000 per hour for that.

What should I advise my Mom? She isn't the type to make a huge issue out of her medical issues.

You don't have the authority to negotiate on your mom's behalf. She needs a lawyer if she's unable to deal with Walmart's rep on her own.

However, she's not going to get a ton of money out of this since she wasn't really injured. Medical bills should be paid and she'll get a small amount for pain and suffering, but not anything like what you seem to think she deserves.

I was only the messenger in this case...as I stated. The fellow from the walmart insurance accepted my Mom's statement that it was ok with her to have me talk with him.

Now, I am asking.. should I advise her to seek major lawsuit against walmart.

If you have any knowledge about such types of cases..I would like to her about it.
If you only wish to tell me that I cannot do what I have not done... let someone else answer.

Did WALMART strap her to the board and leave her there for hours?

Here's the thing - you already GOT an answer.

Feel free to help your mom contact a few attorneys to see what they say. I happen to agree that $2,500 total is a bit low...but mom's not going to get a huge windfall either.

Tell them that you mother wants a written settlement offer, as there seems to have been a misunderstanging regarding the previous 'agreement'.

From what I know of Walmart, they will make an offer that they feel is fair, and will fight you tooth and nail if you take them to court. They also offer seminars for attorneys who want to sue them.

If she does decide to go with a lawyer, make sure s/he has sued Walmart before.

Yes. Contact a "Major Lawsuit Attorney" so mum can bankrupt Walmart.

Liability is pretty clear, but damages is the difficulty here. How much was mom hurt?

The ambulance and all the medical care until the problem is resolved should certainly be the lowest amount possible. However, the insurer (medicare), may want subrogation for any money it paid "conditionally" so make sure the demand of Walmart includes the full cost of the medical care and not just the amount out-of-pocket. Because if this calculation, it would probably be better to get at least a consultation with an attorney before settling.

Why would you want to push your elderly mother to go into the stress of litigation with a company like this?

Agreed with others who state $2500 is low but the idea of $2000 per hour for this ordeal, that is just silly.

I doubt your 85 year old mother and 89 year old father wish to live out the rest of their golden years with that kind of stress!!!

Considering they did a transport, MRI, x-rays, one can only imagine that $2000/hr must add up to at least $20,000, $40,000+. What is an 85 year old woman going to do with that kind of money? Let her children inherit it?

If you are acting as mom's mouthpiece, that counts as negotiating on her behalf, even if you are only repeating exactly what she tells you. She really needs a lawyer. She will not get anywhere near what you think she deserves, but she should get her medical bills paid and a small amount for pain and suffering. Like I said before, and others said after.

Just an aside but it would make perfect medical sense to keep your mother immobile until testing could rule out issues such as spinal injury.

Absolutely, it may have been unpleasant for her, but if she'd had a spinal injury, moving around could have killed or paralyzed her.

Contact personal injury attorney. Settle for three to five times medical costs.

Walmart will fight tooth and nail. It could take years. They are perfectly happy to spend far more in legal fees to avoid a large settlement. They have a well-deserved reputation for being hard to sue.

I don't think 3-5x medical bills are warrented in a case with no actual injury. The bills were legitimately high because the tests she had were necessary, but her pain and suffering was minimal and the tests came back clean. Realistic expectations are important. A couple of hours of discomfort having to stay still waiting for test results, and a week or 2 of headaches, are not worthy of a $10k+ award (above the cost of the medical bills).
