What is the name of your state? Michigan. Hi i was just wondering if any of you attorneys out there could answer me this. I'm pretty sure i know that in my situation im about to explain, i can no longer take any form of legal action, but here goes. Last Febuary, i was driving in Flint, MI and it was semi wet/icy. The roads in town are some of the worst in the state. I hit a pot hole and my GMC Jimmy flipped and was totalled. I was in shock mumbled to the officer i didn't want an ambulance, i really didn't know what was going on .... my suv rolled about 2 times. Anyways the pothole caused this and i have photos of the road , where my car was and the pot holes. I am just wondering if it is to late to sue the city for negligence. I heard i had to act within 90 days and its been over a year now. The other big thing is, i wasn't initially "hurt" in the accident. I went to the hospital with my mother as soon as she came to the scene and got catscans and x rays. At the time the nurses were kind of shocked and told me my neck was "kinked" or twisted. and now a year later i have pain in my neck but no "medical" evidence to prove i was injured physically. What can i do?

Sure they do. But then you show me any law, statute or court case where you have no responsibility to dirve in an attentive manner. Like, noticing there is a pothole and avoiding it.

Yes, you have delayed too long in pressing your claim. Further, even if you had a claim, you would have to have at least SOME proof that the city knew or should have known of that specific pothole and was negligent in not repairing or marking it.
