My property is going through a deed in lieu, and HOA is suing me for not paying the hoa dues, will I be still responsible for lawsuit, after the bank takes over the title of my condo?
**A: yes since the deed in lieu only pertains to a work out with the mortgage lender and not with the HOA. Once the bank takes title, they will be responsible for the HOA fees from that point on. You still remain liable for HOA fees up to the date of new ownership transfer, unless the lender agrees to something different.
