I live in a townhouse condominium complex, and everyone is assigned one space in front of their townhouse units.
My husband and I purchased a brand new white van and registered it with "combination" plates. We have had this van since Nov. 1, 2006, and have had it parked inside our complex with no complaints from the HOA. We just got the van lettered with our company name on it, and As soon as we parked it, we received a call from the HOA president telling us that we could not park the van at our complex because it was in violation of our bylaws, because it is a commercial vehicle and that one of the residents said it brought down the value of our property.
I argued that we do not have commercial plates on the vehicle, that the vehicle has combination plates and that the vehicle is both our business and personal use vehicle.
The Bylaws state: "No commercial vehicle may be parked on any part of the property, except those vehicles that are temporarily parked on the property that are servicing the property itself".
Do we stand a chance to fight this, or do I have to look for parking elsewhere?What is the name of your state?
