California HOA law....

Our HOA president suggested at a board meeting that she not have to pay monthly HOA dues in exchange for her time and effort as board president. Unclear about the specific bylaws- the owners voted yes to have her receive this stipend. Several years have gone by and the president is not fulfilling her duties to hold regular HOA meetings, make appointments for annual fire alarm inspections, etc.

i just discovered that it clearly states in the HOA bylaws that no director shall receive any compensation for any service rendered to the association. they can only be reimbursed for actual expenses incurred in the performance of duties.

Even though the homeowners at the time voted "yes" to give the HOA president monthly stipend (doesn't have to pay the $245 monthly dues that all other homeowners pay), can I know demand as a homeowner that this money be reimbursed to the HOA association since the bylaws clearly state this is against rules?

Suggestion do some more research to learn if the decision to allow that offer of compensation followed the rules for meetings and membership voting , this way if the rules were followed and its a matter of the by laws not being updated then its likely not much more could be done, but if they didnt follow the rules then your free to speak to a atty who has experiance in HOA oriented law and learn what your best options are to get the board to put a end to this.

I am a board president. Our bylaws prohibit the payment of any form of compensation to any board member or president. This is common. You serve because you care, not for pay. This person should not be serving. When are elections? Stop the pay. Changing bylaws is not as simple as a vote at a meeting.
