Recently my HOA has been targeted for litigation by a next door neighbor. To make a long story short, trees on the neighbor's lot were growing onto our property, so we agreed in an HOA meeting to trim the tree branches that are on our property. One of the trees on the neighbor's property that is adjacent to our Condo building is an Accacia tree, which "tree experts" deemed may hurt our building's foundation in time. The President made the decision to cut down the tree completely without consulting the HOA or requesting a HOA vote, sending a tree trimmer to trespass on the neighbor's property and cut down the tree to the stub. The neighbor has now served our HOA with a semingly valid lawsuit. Is it the fault of the HOA or the individual HOA president in this case?
