What is the name of your state?Texas is where I live. My HOA said I owed late fees for the year 2002. I called and told them I paid all my fees. They would not send my information to show how I owed more fees. They would only send a new bill with even MORE fees. As a result, I decided not to pay 2003 fee, even though they still sent bills. In March of 2004, I decided to go ahead a pay 2003 and 2004 fees. However, I explained to them that I would not be late fees since I tried to get an explanation and no one would give me one. They sent the check back and stated they wanted the full amount or nothing. Now in August an attorney has written to say they are starting foreclosure proceedings against me for non payment. In Texas, they can not file for late fees and the such. But they are filing because I didn't pay my annual assessment. Yet, I tried--they sent it back to me. Now what?
 


try to work it out

You should have paid the fee and then sued for the return of any overpayment. Failing to pay put the association in the right and you in the wrong. If you ask the tax accessor for an explanation about your taxes, you would not get one. If you don't pay your taxes, they can become a lien, just like your HOA dues.
Try to work things out -out side of the court system and save yourself time and money.
