Can yo help me with iformation on how to ensure my Holiday Visitation time this christmas?
Current court orders say I get daughter christams morning, my Ex- wife refuses to give her up, wants me to take week later.
She has never been flexible nor accomodating for any reason.
I have reminded her of court order dates as well as my atty sending a letter reiterating my time.
She still says she will not release her to me.
My question is what are my options, if I go to pick her up and she is not home or ex refuses to release her to me.
I know after the fact I can file a motion, but what do I do to guarntee my visitation this X-mas.
Please help, I want my time with my daughter.

This sucks.. but there is nothing you can do. Just make sure you have proof that you have requested the time and also get proof of you turning up and being refused. Then nail her in court. Even then, a judge may just slap her wrist. Personally I would add extra visitation to the petition and state that I needed more time to build the relationship that the mother is trying so hard to destory.

I suggest one final letter to her and state, in no uncertain terms that you will be filing contempt papers into court on the 26th of December should she refuse you visitation on the 25th.

have been to court regaarding this matter before, as well as many others, RE dotting every "I" and RE crossing every "T" alot of $$$$ and time, yet she always seems to get repremanded verbally, it seems like she feels she is above the law, and seems she can get away with doing it over, and over, and over

When you stop getting a pussy of a judge who will protect your rights.. how many times has she been found in contempt ?

zero times, threatend twice by judge,
This is a small town, every hearing has been with the same judge, I hope this time will be the final NAIL in EX coffin

Just want my time i deseve without same argument year after year after year
She is the most selfish woman I know and uses child as tool

Then keep filing those petitions.. and remind the judge each time with the history of the complaints.

what do you think my chances would be to demand custody and/or at very least more visitation time?
She does have 2 nd child, half sister, not mine. Would they still consider giving me custody?
Also how do I go about getting mom(ex-wife) to have mandated phys evaluation?

this is evidence for you to use to obtain custody- if thats your goal- one reason is denying visitation. Unfortunalty its probably not enough

Hello. I am new here.
I just want to share with you what my husband did.
He ex was refusing to let him have the kids for Thanksgiving. It was his year. They alternate.

He told her he WOULD be there to pick up his children. He could come by himself OR bring the police. It was up to her, he told her.

It worked. He picked up the kids without any problems and without the police.
Just a thought and my 2¢.
