I sold a horse that I've had for 12 years, I raised and trained her. She has always been gentle enough for beginners and small children. A lady bought her for her 6 year old daughter. Before she bought the horse, she asked for a 2 week return policy and I declined as its too risky for the seller (me). This lady rode the horse, had her experienced horse friend ride her, had a very extensive pre-sale vet check done, and talked to a trainer who had very recently leased the horse for 6 months to use as a children's lesson horse. The vet and trainer both said our mare would make a wonderful horse for her daughter. Prior to paying for the horse she sent me an e-mail saying to consider the horse sold, but would I agree to a return policy if the horse had something major wrong with it. Just to reassure her that the horse had no issues at all, and to try and assure her of my honesty, I wrote back in an e-mail that if the she got the horse home and it ended up having something major wrong with it (unsoundness, bad habits, etc) that she did not cause or have control of, and that made the horse unusable by her, of course I would willingingly return her money for the horse. After she got the horse home she called and said the horse was kicking and biting her and wanted to return it. I know this horse and she would never act this way unless provoked and "trained" to by mistreatment. Now this lady is threatening to sue based on my e-mail, she is calling it a "contract". I told her twice prior to the sale that I would not do a trial period, that the sale was final. Is the e-mail letter the same as a contract, even though that was not my intent?What is the name of your state (only U.S. law)?
