I also find it a little hard to believe that as an RN, you are limited to working in this unique place where 99% of the nurses are Filipino and ALL hate you so bad they'll sign an email slandering you. Where the only HR person who would try to help you was fired...perhaps because they all hate you too? (theme from Twilight Zone plays here)

There's always the option of finding another job site where you are happier, and everyone doesn't hate you. I honestly do not think from what you're telling us here you're going to have much of an EEOC case, and it will certainly take a loooonng time to pursue, even if everything goes completely in your favor and you are issued a right to sue letter

I think you are a layperson who believes there is truly a law out there against causing you to be mistreated and unhappy and stressed out in the workplace, and that all you have to do it get it before the right court or board and that you're going to be justified and petted and monetarily reimbursed for your struggles.

From personal experience with filing EEOC complaint, it can take a really long time to be completely investigated.
What exactly do you want to happen with your work situation?

Okay, let's say that everything works entirely in your favor and the EEOC finds for you and you are able to sue and a lawyer takes your case on contingency and you win big in the lawsuit.

It's going to be a MINIMUM of a year before you see a penny of compensation, and a year is an extremely optimistic estimate.

So, while all that is going on, how do you anticipate your workplace environment playing out? What do you think your days are going to be like on a regular basis?

What do YOU think is the smart thing to do?

OP, you still haven't answered our questions about what "foreign" training has to do with any of this, and also how you managed to see a lawyer on a Staurday, and why that lawyer didn't bother to tell you about going through the EEOC before suing. We wouldn't have asked those questions if we hadn't been interested in your answers.

well, appears I am getting what I really wanted... today I am meeting with the senior human sourse lady for all the owned hospitals. They have conducted an investigation and found the allegation to be TRUE and are willing to have a sit down meeting with me to see if they can make it right by me. What I want is simple. I want my job back. Not the one I had, but one in the one of the other owned hospitals that I wont be harrassed in. I do not want to sue my employer. I just want to go back to work and I want accountibitility for the actions of those of drove me out of my job. Wish me luck please.

ok, the lawyer , was one of the tv lawyers you see on TV.... ya know... I'll fight for you! The Human Resource lady mande the appointment on monday ... I agreed to give them one last chance... meeting didnt go so well. She was shocked and surprised over the evidence I have and promised head are gonna roll. But could not promise me a job in another hospital closer to home. So, off goes to my letter to the EEOC. I have give them every chance. I have also found a good lawyer who will take the case without waiting for the state to finish their investion. I have done all Ican. This could have all benn avoided. I just wanted to come back to work.... just not back at the same hospital for the harrassdment all over again. Sa sad. The is not what i wanted. With the evidince I brought to her to do, she could only promise that the suspense and termenation would follow. But I would NOT be retaliated agaisnst. ( sure) She said the the little documentation I brought today was boh shocking and disgusting. will keep you posted. Wish me luck..... Please......

Prior experience with EEOC (from employer's perspective) is that it can take upwards of a year to year and a half to get a resolution, if found in your favor.

Even a TV lawyer knows that you'd have to go through the EEOC before you could sue.

In addition, I'm very surprised that an HR professional would use the words "shocking" and "disgusting" to a complainant even before conducting an investigation. And no HR person anywhere has the authority to fire non-HR people, no matter how egregious their actions, so I'm also finding it hard to believe she said "heads will roll" to you.

Finally, you still haven't explained what your former coworkers' "foreign training" has to do with anything.

There's still way more to this story than you're letting on.

File a complaint with the EEOC.

Call some emplyment law attorneys and get a consultation.
Beware of the EEOC. The EEOC will give you the right to sue. They will not otherwise help you. The EEOC only helps if:

1) Some employer or ruling threatens the power of the EEOC.
2) A huge dispute involving many, many employees of a large factory.

To sue for illegal discrimination, you need the EEOC or equivalent state agency for the right to sue letter. The deadlines are fixed. Miss it by 1 day and you lost. There have been court cases that affirm the deadlines.
