An hourly teacher in a California private catholic school has returned to work after a medical LOA. Due to her medical condition she travels with a walker and finds it sometimes difficult to climb up and down stairs. Some of her classes are taught upstairs, some down. The Principal had said, in staff meetings, that she has concerns that, should the teacher fall, a workman's comp case will result. Though it is possible to move the teacher's classes and avoid use of stairs, the Principal has instead opted to cut the teacher's hours to keep all classes on one floor; the teacher's other classes she were given to another teacher. Does the teacher have any protections under the ADA or discrimination law? Thoughts are appreciated.
