What is the name of your state (only U.S. law)? GA

Situation

Mortgage payments behind. Modification paperwork submitted. No response from EMC - said its processing. Still got monthly 'invoices'....then suddenly we call and was told the home has been sold a few prior to the call. Paperwork cannot be found - home in limbo - somewhere.

Is is legal for EMC to foreclose on the home without telling us about the sale and giving us any warning??:confused:

Did you not get the notice of sale by certified mail 15 days before the sale?
Just because they continue to send you bills doesn't mean all is good.
Georgia has very short and minimal notice requirements.

No there was no notice in the mail...just the regular statements.

However - I asked for future reference. But I think EMC was and still is playing games. I just called and was told I was eligible for a modification - though last week I was told the house was sold. However when I asked about the new lock on my door - I was told ooops...sorry - the house is sold BUT I can have it back if I pay the entire loan balance ! That was confusing and I am just tired of the games with that company.:mad:
