House is up for Sale.

What is the name of your state? Ohio.

I got a notice in the mail this morning that our house was up for sale. This notice was from a lawyer telling me who the Realtor was.

Our 1 year lease was up as of June of this year, so we are now on month to month.

I went online to look at the listing, and saw that not just my place, but everything on this block minus the two corner lots are up for sale, zoned commercial going for a low price.

The listing for my house states we have central air, (news to me lol).

So my question is, what are my rights in this matter. I planed to move to Texas at the end of the summer 2008, but it looks like I may have to speed that up some.

So when the the new owners take over, I was informed they could force me to move and simply give me 30 days notice.

I don't have enough saved up yet to move without a major burden, so I would prefer to stick to my plan. Can they simply force me to move out if they don't want to keep renting the place?

**A: read the Ohio L/T law. Your rights are there.

I have been through everything I can find online, there is nothing in the standard fare that details the landlord selling the house and the tenants rights.

If you know of one such document a link would be appreciated.

Simple answer... yes.
Without a term lease, you are a month-to-month tenant. As such, either you (tenant) or the landlord have the right to give a simple written 30 day notice to terminate the 'lease'.

Ok, so they can evict me if they so desire, understood.

A secondary question.

When I started renting this house the owner was aware I wanted to purchase it, we wrote up a contract stating after 6 months of faithful payments I would be able to exercise my option to buy when he decided to sell.

I do have a written contract on this.

Yet I was informed of the house going up for sale, via post from a lawyer and a website listing.

According to our agreement he was supposed to notify me of his intent to sell and give me first option on it. I never received this notification, and the house is now on the market.

Is there anything I SHOULD do about this, I am not trying to screw the guy, I like him, he has been a fairly good landlord, but I want to make sure I am covered.

If you are interested, make the landlord an offer to purchase. The landlord will accept or refuse.
There is nothing to prevent you from trying to purchase.

That is confusing. How do you think you are NOT covered??

I just know that according to our written contract, he was supposed to inform me before putting the house up for sale, he broke this contract obviously as I heard nothing from him when I paid my rent, and surely he knew he was planning to put the place up for sale at the beginning of this month.

So what?? The property hasn't sold, you still have the opportunity to try to purchase (just as any other potential buyer) and have NOT suffered any 'damages'.
Either make an offer to buy or start packing.

OP doesn't still want to purchase since he's moving to Texas in a few months. He just wants to know if he can get anything out of the LL for supposedly breeching the contract. The answer to which is, no. Since you don't want to buy the house anyway, why do you care that you weren't notified?

I have read through every single LL/Tenant thread here, and there is always one common point to the threads, the LL's can do no wrong and are gods, and the tenants are always scum.

You guys make me sick.

As a side note, My LL is a nice guy, probably just forgot about the contract, but that doesn't make it right.
And me? Well I pay my rent on time, live nice and quietly, keep the house nice and even do some minor fixing up on the place on my own dime, I think I am a damn good tenant.

Agree agree agree with MandM all the way!!! There are good and bad landlords as there are good and bad tenants. I'm a good tenant, exactly as you say MandM.... Kudos to you.

And of course, you are not correct. Just as anything in life, there are good tenants and the law 'protects them'... and there are bad landlords... who the law will deal with.
The one factor that you seem to forget is that landlords, in holding the security, CAN do whatever they want... and it is entirely up to the tenant to exercise their rights by filing in court.

You guys make me sick.
And you, with all of SEVEN posts (at this time) full of whining, 'warm-fuzzy', no legal experience make me 'sick'.

That agreement probably expired with the expiration of the initial lease that it was a part of. Nonetheless, if you still want to buy the house, go for it. It's apparently available.

I have kind of the same situation about my house getting sold. I am going to see a lawyer on Monday. My landlord said he plans to sell the house and wants us out by the end of December. Nice timing, ha? I have a lease that ends Jan 1st. Then it goes month to month, from my understanding he has to serve me a 30 day notice on Jan 1st. I am not sure what your rights are in Ohio is it? But, I am going to find out what mine are here, cause I can't afford to just pack up and leave right after X-mas.
