Live in GA. Recently engaged. My fiance has been divorced for 3 yrs, marriage, and divorce took place in Fla. They have no children together, although his X has 3 children from 3 previous fathers. When they were divorced, he agreed to make house payment for 5 yrs. He has been paying the payment until about 6 months ago when the mortage was bought out. We called the new mortage co, they wouldn't forward payment book or information to us. He stopped making the house payment. We rec'd papers in mail yesterday, she wants him to go back to Fla. for hearing, it is set for 5/4/2001. During time were divorced, he was bouncing back and forth, living with her, trying to reconcile their differances, but never remarried. He continued to work and make house payment while there, and while not there. The X wants him to make lump sum payment for house payments, for the 6 months he missed, which is fine, but also for all the time he was there living with her, and making payment.
one final question. Can he take her back to court to get it to where he no longer makes the payment? Can he counter her? He tried to talk to her last night to come to an agreement. She refuses. Would it be worth it for us to hire a lawyer, and persue this? He never hired a lawyer, and she just keeps coming at him for more and more money. I'd rather pay a lawyer than her if we have to keep paying someone, especially since the children are not his, and she does rec child support.
