How can we force a public defender to work?

What is the name of your state? Florida

My husband is arrested for first felony degree.First he had one public defender,he quited and now the second public defender refuses to defend him as it should be!How can we force him to provide us discovery and how can we compel him to call witness on my husband's behalf?It sounds absurd but it is true and he is supposed to be our lawyer!Also we want to file pretrial motions but he refuses to enter them into court record.It is violation of my husband's rights but it seems that nobody cares!!!I appreciate any answer or advice!

When did you get your law degree?

Did it occur to you that maybe, just maybe, you don't know everything there is to know about how the laws and the courts work and that just because YOU think the case should be handled one particular way, doesn't mean you are right?

Nahhhhh. She quitted law school right before they teached that part.

It is not a violation. The attorney cannot do a lot of things: Enter frivolous motions in order to stall or annoy or harrass the court; put witnesses on the stand who he believes may perjure themselves. Attorneys also do NOT have to provide you with discovery. The attorney gets the discovery not you. And the attorney is NOT your attorney -- get rid of the "our". The attorney represents YOUR HUSBAND!

I saw a post very similar to this one on another board. The poster spelled out specifically what he though the PD ought to be doing, and the responder, who was a PD, spelled out precisely why each and every point the poster addressed was either illegal or not in the best interests of the defendant.

Some people watch enough episodes of Law and Order, they think they're experts. They tend to forget that Sam Waterston is working from a script.
