Hi, I'm new and have just one question. My husbands ex wife has recently took back her married name, her madin was Smith, then married my husband took his last name, they have a son together, divorced my hubby, got got married again went to Story a different last name and went with it for almos 8 yrs., now just recently the son has started jr high school and we talk every great once n a while and she has told me that she has taken on my husbands last name again now that the boy is in jr high. We live in ohio and she lives in alabama we don't see the boy all the time my husband does pay child support. How can she do this and my husband not be notified and will this effect anything with me and our son now?

Her reverting to use of your husband's name will have no more effect on you than if she decided to name herself Queen Sheba.

But how did she revert back to his last name after taking on a new one? to go back to his name again would she just chage her social and drivers licence, or does she have to go through a court? Plus in alabama common law marriage does exist so since she is living with a gentleman for almost 8 years, why choose an ex husbands name to revert to?
can this effect any of our credit or finaces? if she didn't have to go through a court sholud we check to see if any thing she did was legal?

Her taking back your husbands name can not affect you in any way. My step-mother did this. After her second marriage, she took back her first husbands name. All she needed was two forms of old ID with the former name on it. I don't know the law there, I am in MI. Reason she did this was to make things less confusing for her children in school. She wanted to have the same last name as THEM, not the ex-husband, to avoid any confusion. Chances are, this is her reason as well. Don't worry about it, try to see it as a good thing. She probably figures she's doing the best thing for her son. It makes things easier on him.

Your thinking is flawed.. she has not taken back *his* last name. She is changing to a name different than her old one.

I think....

I believe that she did that, maybe so her son wouldn't be embarrassed with her having a different last name than his.

This is very important to kids, especially starting a whole new school and an upper grade.
