How do I file an insurance claim?

What is the name of your state? Alabama

Someone ran the red light and hit me.
He admitted fault to me and 3 police officers.
The police report also shows it was his fault.

On the police report it shows the name of his insurance company.
It does Not show a phone number, claim number, fax number
or any way to contact them.
The police officer said for me to contact My insurance agent
and my insurance agent would contact His insurance agent
and get back with me.
Shouldn't his insurance agent be taking photos of my damaged car
or something? I faxed all the information to My insurance agent.
And now I am waiting to hear something next week.
The accident occured on September 7, 2006.
Is this how to handle it? Am I doing the right thing?
How do I file an insurance claim so I can have my car fixed ?
I'm Confused !!! :confused:

Or you can use the yellow pages to contact their insurance company. You have the name, all you need is a phone number. Getting your insurance company involved is not a bad idea, but the less people you have to speak to, the easier it is. If you do directly through their company, you're only talking to their adjuster. If you go through your company, you will need to have conversations with 2 adjusters. Good luck.

I did not have the insurance I thought I had. I found out my insurance company
sold me liability medical only. No collision insurance.
Can I sue my insurance company for not selling me the insurance
I thought I bought?

Also the man who hit me is from another state, has No insurance,
he works in the Fair/ traveling circus.
The insurance on the police report is not valid.
The man gave me a different insurance name and claim number.
So I have 2 different insurance companies.
The one on the police report - not valid
and one on a piece of paper he gave me- can't find them, no phone number.
I have 10 different phone numbers I have called trying to track
down his insurance company. One said it was cancelled.
And today they said they found it, gave me a claim number and agents name
and now waiting to get in touch with him.
Consulted a Lawyer today and he said we were stuck with a 5,000 dollar bill
and Theres Nothing we can do about it.
I wished I had died in the accident.

No, you can't sue your insurance company. It's your responsibility to know what insurance coverage you have. Minimum coverage NEVER includes collision.

I'm sorry that the guy who hit you had no insurance. You can file in small claims court against him, but you'd need to do it in the state where he lives, and if he doesn't have any assets, the chances of you collecting from him even if you win are slim. It sucks. Maybe the last company you talked to will turn out to be the right one.

First off re "I wish I had died in the accident" - don't talk like that --- an auto acc. (even with claim problems) is no reason to feel that way. Things will work out & get better.
No, you can't sue your ins. co. for not selling you the ins. you thought you bought. It is your responsibility to be sure you are maintaining all necessary coverage on your car.
Maybe you will hear from your ins. company's agt. or the other person's ins. companys agt. shortly. I would see what they have to say. I'm not sure just what you mean by the lawyer's statement - are you saying he thinks you are stuck with paying for damages to your car. ($5,000) A person can sue for damages if car ins. doesn't pay for them.
